Gambling winnings tax in Florida

Florida has no state income tax, so it does not tax your gambling winnings as income.

Checked against Florida’s own sources on 2026-10-05.

In short

  • If you owe a Florida state agency, or past-due child support collected through a court, the Florida Lottery takes it out of a prize of $600 or more before it pays you.3
  • If you win a Florida Lottery prize of $250,000 or more, your name stays confidential for 90 days after you claim it, unless you agree to its release. This rule ends on October 2, 2027 unless the Legislature renews it.4
  • Legal sports betting in Florida runs through the Seminole Tribe. A sports wager placed anywhere else is most likely illegal, the state’s gaming commission says.5

How Florida treats gambling losses

1

Florida has no income tax, so there is no Florida return for your losses to change. They still matter on your federal return, and can matter on another state’s return if you won there.

The two examples below are the same numbers the calculator uses. With no Florida income tax, only the federal figure changes.

Two examples, worked at 2026 federal rates

A single filer with $60,000 of other income who takes the standard deduction on everything except gambling losses.

A losing year

You win $50,000 and lose $52,000, so you finish down $2,000.

Federal
$3,596
Florida
$0
Total
$3,596

You finished the year down and still owe tax.

Federally you itemize, so your losses offset your winnings, but the 2026 rule caps that deduction at 90 percent and leaves $3,200 taxable. Florida has no income tax, so none of this is taxed at the state level.

A winning year

You win $50,000 and lose $10,000, so you finish up $40,000.

Federal
$10,350
Florida
$0
Total
$10,350

Federally you take the $16,100 standard deduction, which is worth more than itemizing, so your gambling losses do not reduce your federal tax at all. Florida has no income tax, so none of this is taxed at the state level.

Withholding on winnings

1, 2

Florida has no income tax, so no state income tax is withheld from your winnings. Any income tax withheld on a win here is federal.

If you do not live in Florida

2

Florida has no income tax, so it does not tax a visitor’s winnings as income either. If your home state taxes income, its own rules decide how it taxes the win, and there is no Florida income tax for it to credit.

More about Florida

Lottery prizes and what you owe

Before the Florida Lottery pays a prize of $600 or more, it takes out any debt you owe to a state agency and any past-due child support collected through a court. Child support is paid first, then the other state agency debts, and you get what is left.3

Sports betting

Legal sports betting in Florida runs through the Seminole Tribe. The Florida Gaming Control Commission says that a sports wager placed anywhere else is most likely illegal.5

Keeping your name private

If you win a Florida Lottery prize of $250,000 or more, your name stays confidential for 90 days after you claim it, unless you agree to its release. This rule ends on October 2, 2027 unless the Legislature renews it.4

The tax on slot machine revenue

Slot machines at the eight licensed pari-mutuel facilities in Miami-Dade and Broward counties pay a tax of 34 percent of slot machine revenue. The facility pays it, not you.5, 6
